If a murder results in no murder charges, one might conclude there was a cover up by prosecutors or law enforcement, or that the criminal was very good at covering his tracks, which might have been there was no surveillance capability by law enforcement to capture evidence required for charges.
If an "insurrection," captured by thousands of cameras, against the most powerful surveillance capabilities of any law enforcement apparatus in the history of governments, yielded years later no insurrection charges (out of 1200ish) levied by the opposite political party who is in charge of prosecutions , one cannot rationally conclude the reason is a cover up by law enforcement. They have every reason and motive to charge and prosecute such a crime (18 USC §2383, btw). One cannot rationally conclude the evidence disappeared before it was detected, either.
Go back to the "murder" without a murder charge.
One might conclude, if there is no coverup, no missing evidence, plenty of motive and opportunity and ability to charge and prosecute, in the "murder" without a murder charge in such circumstances, that the best explanation in such a case, there was no murder after all.
Similarly here. In the "insurrection" that produced no insurrection charges in such circumstances, that the best explanation is that there was no insurrection on January 6th 2021.
