Stare Decisis, the Constitution, and the Common Law
Justice Gorsuch Teaches Anglophilic Law to American Constitutionalism
Folks, if you're interested in Law, the topic of "stare decisis" is a very interesting one in our Constitutional system. I highly recommend Justice Gorsuch's recent concurring opinion in Loper Bright. It is the best discussion of stare decisis in our Constitutional system I've seen in recent years, and you'll learn a bit about Administrative Law, ta boot. Highly recommend. He's the only member of the current court academically qualified to teach America about how it fits in with the Common Law system that preceded it in England (he's got his doctorate in legal Philosophy from Oxford, where Common Law was invented and developed).
The Loper-Bright decision can be found here. Gorsuch’s concurring opinion begins on page 48 of the PDF.
Dr. Lucas J. Mather, Ph.D. spent 6 years in Seminary before earning a doctorate in Public Law and American Politics from the Claremont Colleges. He is the host of The Republican Professor Podcast.
